Lawyer: Alcohol testing device is racist By DANIEL TEPFER

A lawyer representing a man arrested in Fairfield for drunken driving says the state's breathalyzers discriminate against black people.

"They are KKK in a box," said lawyer James O. Ruane of Shelton. "We really have some racist machines here."

Ruane represents Tyrone Brown, 40, of Burritt Avenue, Norwalk, who was arrested April 9 by the state police on Interstate 95 in Fairfield and charged with drunken driving.

A breath analysis administered at state police Troop G in Bridgeport found Brown had a blood-alcohol content of 0.188. The legal limit is 0.08.

In a motion filed Tuesday in Superior Court, Ruane asked a judge to suppress his client's breathalyzer test results, contending the device used by the state police, and most other local police departments, the Intoxilyzer 5000, discriminates against blacks. Brown is an African-American.

Assistant State's Attorney Mark Durso declined comment on the motion.

Ruane claims the lung capacity of a black man is 3 percent smaller than a white man and, therefore, black men's test results vary from the sobriety standard set by the device.

He said Dr. Michael Hlastala, a lung physiologist at the University of Washington, examined research of other lung physiologists and, based on his studies, has determined the Intoxilyzer 5000 does not effectively test the blood-alcohol content of black men.

"He looked at all the research and came up with the bigger picture and found the common thread," he said.

Ruane said he intends to have Hlastala testify on Brown's behalf.

"The data is very clear," he said.

Both companies have poured money into lobbying and campaign contributions to federal candidates, parties and committees as a general tactic, but they've also directed those contributions strategically. In the 2006 election cycle, Fannie Mae was giving 53 percent of its total $1.3 million in contributions to Republicans, who controlled Congress at that time. This cycle, with Democrats in control, they've reversed course, giving the party 56 percent of their total $1.1 million in contributions. Similarly, Freddie Mac has given 53 percent of its $555,700 in contributions to Democrats this cycle, compared to the 44 percent it gave during 2006.

Fannie Mae and Freddie Mac have also strategically given more contributions to lawmakers currently sitting on committees that primarily regulate their industry. Fifteen of the 25 lawmakers who have received the most from the two companies combined since the 1990 election sit on either the House Financial Services Committee; the Senate Banking, Housing & Urban Affairs Committee; or the Senate Finance Committee. The others have seats on the powerful Appropriations or Ways & Means committees, are members of the congressional leadership or have run for president. Sen. Chris Dodd (D-Conn.), chairman of the Senate banking committee, has received the most from Fannie and Freddie's PACs and employees ($133,900 since 1989). Rep. Paul Kanjorski (D-Pa.) has received $65,500. Kanjorski chairs the House Financial Services Subcommittee on Capital Markets, Insurance and Government-Sponsored Enterprises, and Freddie Mac and Fannie Mae are government-sponsored enterprises, or GSEs.

I know there are a lot of us pissed off about whats going on in Detroit, but how about we focus on our own backyard?

 

I'm talking about Pontiac.

 

Just about everyday the Oakland Press has a story about the crime in Pontiac.

 

Its Oakland county's county seat for gods sake. Why are we so worried about Detroit when crap like this is going on in OUR YARD?

2 homeless men beaten

Those living on streets fearful they could be next

PONTIAC In two days, two homeless men were found savagely beaten in the same manner and within walking distance of each other in the downtown area. The brutal pummeling each man suffered has left investigators puzzled as to how someone could be so cruel.

"You don't know who they are, they could be anyone," said Sgt. Kevin Braddock, adding these men are someone's brother, father or son.

The names of the men aren't being released until family members are notified of the attacks.

However, people working closely with the city's homeless say word of the first attack spread quickly through their community and many of those living on the streets are fearful they could be next.

The first man reported to have been assaulted -- a 61-year-old who reportedly goes by the name Frenchie -- may not survive the attack, Pontiac police said.

It was just minutes after 10 a.m. Thursday when a citizen told a POH Regional Medical Center security guard there was a man sleeping next to a trash bin in an alley that backs up to the Crofoot ballroom on Saginaw Street.

The security guard went to check on the man and discovered he was actually unconscious, with visible injuries to his head.

The Pontiac Fire Department was called to the scene and rushed the man to POH where he was taken into surgery.

Police say doctors had to remove blood clots from the man's brain and he was placed in the intensive care unit.

The Oakland County Sheriff 's crime scene investigators also were dispatched to the scene to collect evidence.

Investigators have also held on to the man's clothes and a backpack believed to be his.

At first, it seemed like an act of random violence.
However, police would soon have good reason to believe the attack wasn't an isolated incident, when officers were dispatched at 2:15 a.m. Friday to the area surrounding the address of 7 N. Saginaw Street about another beating.

This time, police found a 65-year-old man lying unconscious. He had injuries to his head and face.

Firefighters took the man to POH, where he was reported to have had surgery for the massive wounds he suffered to his head.

Investigators were unable to get information from the man about the attack because of the severity of his injuries.

However, police say a witness indicted he heard a "commotion" about 1:30 a.m. and saw two men walking from the area of the assault toward Wayne Street.

Braddock says it is unknown if the two men are connected with either attack, although investigators are hoping security cameras at the Crofoot ballroom will give them a clue as to who attacked the first man.

There is a strong indication the attacks are related because of the time span and proximity to each other, he added.

Meanwhile, Michelle Tocco, a kitchen assistant at the Baldwin Center, said several of the homeless were talking about how the man they know as Frenchie had been attacked this week.

Amongst many of its programs, the Baldwin Center hosts a breakfast for the homeless Mondays through Fridays.

Part of the Baldwin Avenue United Methodist Church, the center seeks to aid those in the community who need it most.

Frenchie is one of those people.
He is known to walk the streets, collecting bottles to get the deposit money, which is what most of the homeless are after, Tocco said.

"We heard bits and pieces," she said. "Frenchie was here Tuesday for breakfast."

Those bits and pieces, however, carried lurid details and had many of their clients frightened.

"A few get jumped on a regular basis," said Tocco, adding that one of their frequent visitors uses a cane and is often attacked. "They are going for easy targets."

The violence in the city is nothing new and is only aggravated by the police department's current struggle in staffing, said the Rev. Kent Clark, who owns the Grace Centers of Hope shelter.

"It's a jungle out there," he said. "When we talk about the homeless, we are for the most part talking about addicts, people who have turned to some drug to sedate the pain of life. Many of them have just lost their way."

This pattern of drug abuse, Clark said, includes the factor of people preying on the weakest citizens.

There also is the issue of homeless people afflicted with some form of mental illness, he said.

Grace Centers of Hope, like the Baldwin Center, provides programs to help people overcome their addictions.

Both shelters provide counseling and educational resources, with the aim to get people off the streets and back into the mainstream community.

"These folks are addicts, and if they are high there is nothing they won't do," Clark said. "There are no throwaway people and addiction cannot be solved by passing out welfare checks or by entitlement programs."

2 cops mugged in Pontiac

Two groups of armed men successfully mugged two unlikely victims: an off-duty Oakland County Sheriff 's deputy and a visiting officer with the Texas Department of Criminal Justice. The muggings happened Monday night and were within hours and less than five miles from each other. Pontiac police say the first to be robbed was the officer, who was traveling with a 23-year-old man and a 21-year-old woman. All three are from Huntsville, Texas, and were staying at the Motel 6 Detroit on Opdyke Road. It was about 8 p.m. when they became lost while attempting to find the hotel. They were at a gas station near the corner of Featherstone and Opdyke roads when the woman asked a man driving a black SUV for help in finding their hotel.

The man told the woman that they could follow him and he would lead them to the hotel.

Instead, police say the three were led to the intersection of Kuhn Street and Dufrain Avenue where the black SUV suddenly stopped.

That's when police say two men got out of the SUV, walked toward the other vehicle and put a gun to the woman's head before demanding money.

The officer, 25, handed over his wallet, which contained his badge, $700 and several credit cards.

The two men got back in the black SUV and fled.
The man carrying the gun is described as black, 5-foot-9 and 190 pounds. The second man is described as black with a medium build, 5-foot-7 and 160 pounds. The third man was also black, about 5-foot-7 and 170 pounds.

It was just a few hours later that a 911 call was made about another armed robbery.

An off-duty deputy reported being mugged about 11:30 p.m. in the 1500 block of Grandville Court, north of Walton Boulevard.

The deputy was getting out of his vehicle when two men walked up to him. The first man asked to use the deputy's cell phone, but was told no.

That's when he pulled out a silver handgun, told the offduty deputy it was a ".22" and asked: "What do you have?"

The second man, meanwhile, reached into the deputy's vehicle, grabbed a wallet and stole the contents, which included $2, an ATM card and a credit card.

The pair also took the deputy's cell phone before running toward Walton Boulevard.

The first suspect is described as black, about 6 feet tall and 170 pounds. He was wearing a black hooded sweatshirt, white T-shirt and black shorts. The second suspect also is black, about 5-foot-7, 130 pounds and was also wearing a black hooded sweatshirt.

Since we all know Supreme ignorance moderates his blogs, and only allows certain comments, lets talk about it here.

Yes, the mayor is black.

Yes, the city council is almost all black.

 Yes, the Police department is run by blacks.

 Yes, Detroit schools are run by blacks.

So why are all these branches of the city in the shape they're in?

The mayor has been blatantly stealing from you for years now.  Started with the Escalade and just kept going.

There may be a chance that certain city council members took bribes to OK contracts.

According to certain members of the fox 2 blogs, the police department kicks the crap out of blacks on a daily basis

And there's at least a half a dozen stories of waste in the school system every school year.

 

Why is it in a the "blackest city" in the nation, blacks allow this to happen to them?

Is it because the leaders know that anytime something comes up they can blame whitey, and certain people in the city just fall for it and excuse the wrong doings of their leaders?

That's my opinion. Lets hear yours.

Border patrol agent held at gunpoint Officers fear Mexican military encounters will turn violent

 

A U.S. Border Patrol agent was held at gunpoint Sunday night by members of the Mexican military who had crossed the border into Arizona, but the soldiers returned to Mexico without incident when backup agents responded to assist.

Agents assigned to the Border Patrol station at Ajo, Ariz., said the Mexican soldiers crossed the international border in an isolated area about 100 miles southwest of Tucson and pointed rifles at the agent, who was not identified.

It was unclear what the soldiers were doing in the United States, but U.S. law enforcement authorities have long said that current and former Mexican military personnel have been hired to protect drug and migrant smugglers.

"Unfortunately, this sort of behavior by Mexican military personnel has been going on for years," union Local 2544 of the National Border Patrol Council (NBPC) said on its Web page. "They are never held accountable, and the United States government will undoubtedly brush this off as another case of 'Oh well, they didn't know they were in the United States.'

I have been reading about the Mexican military violating our borders for years.

Back when this nation actually had a backbone that would have been considered a act of war.

Well he brought change alright. What was once referred to as the bread basket of Africa is now referred to as the basket case of Africa. And rape murder and torture are the norm.

"COLORADO SPRINGS - The Texas Rangers consider a Colorado Springs woman arrested on a false reporting charge a "person of interest" regarding calls placed to a crisis hotline in Texas.

The calls resulted in more than 400 children being removed from a Fundamentalist Church of Jesus Christ of Latter Day Saints (FLDS) compound in western Texas.

Two Texas Rangers, who traveled to Colorado Springs Wednesday following the arrest, say they found several items indicating a possible connection between Rozita Swinton and March 2008 calls placed to a crisis center hotline in San Angelo, Texas, regarding the FLDS compounds in Colorado City, Ariz., and Eldorado, Texas.

These items will be evaluated and forwarded to various crime laboratories in Texas for analysis. The Texas Rangers will not comment further about the items.

Swinton became "a person of interest" several days after authorities raided the Yearning For Zion (YFZ) Ranch in Eldorado, Texas. The child abuse center in San Angelo told law enforcement about several distressing calls from a female caller, who said she was inside the YFZ compound and needed immediate help. That prompted the raid.

Texas authorities say they worked with numerous law enforcement agencies in the United States and Canada, including the United States Marshal's Service in San Antonio and Denver and the Royal Canadian Mounted Police in British Columbia, Canada, to find Swinton.

Colorado Springs Police arrested Swinton at her home on Wednesday on a charge of false reporting to authorities, a misdemeanor, for an unrelated incident that happened in February. Swinton was taken to the El Paso County Criminal Justice Center and released.

9NEWS has learned that Swinton was arrested in Castle Rock two years ago for making a false report.

The Colorado Springs Police Department says it cannot discuss the Texas case.

The Texas Rangers say they are continuing their investigation into the underage marriages of adolescent females with older males within the sect. "

"Fairfax, VA -The California State Supreme Court has ruled that Proposition H, the draconian gun ban proposed by the San Francisco Board of Supervisors violates California law. This exhausts all possible avenues for appeal by the Board of Supervisors. Proposition H would ban the manufacture, distribution, sale and transfer of firearms and ammunition within San Francisco. The National Rifle Association was the lead organization fighting this ban."

Well, it seems that one of the sticking points with the Dems regarding a do over is the Democrats that crossed over and voted in the Republican primary in January.

It appears that between 42,000 and 72,000 Democratic crossed over, and they would be barred from voting in the do over.  And since Clinton was the only major Democrat on the ticket, it more than likely they weren't her supporters that crossed over.

Michelle Obama proclaimed yesterday that for “the first time” in her adult life,” she was proud of America, as she spoke during a rally to support her husband’s presidential bid.

IMO, this was completely out of line. I may not be proud of some of the actions my government takes, but I have NEVER not been proud of my country.

This country is a beacon of hope for people world wide.

I think statements like this just go to show the mindset of the Obama's. Do we really want people that aren't proud of the country running it?

The Oakland Press is reporting today that there are recordings of Stephen Grant and his sister joking about his slain wife Tara in jailhouse conversations.

It says  that before Tara's funeral in March, Stephen and his sister joked about whether Tara's body parts would be buried in one casket.

It also states how they were trying to figure out a way to make his sister his manager so he could write a book, and keep the profits.

Copies of the transcripts should be available later this month to media outlets that file a FOI request.

I think this is just one more example of why people like him deserve the death penalty.

I also believe that this just goes to show that his sister has no business having custody of those children, or even visitation for that matter.

Taking your fingerprints for a traffic citation? Seems to me its only an excuse to get you in their system.  Am I the only one that finds something wrong with this?
